The Property Selling Process

Once you’ve decided to sell your property, you will need to have a Contract for Sale of Land prepared. This binding contract will include:


  • The items that are included & excluded with the property
  • Any special requirements you might have in mind
  • The legal terms and conditions of sale


Your conveyancer will explain your disclosure responsibilities. Note that a failure to meet these obligations can lead to legal trouble. Once a buyer has been located, the mortgage contract can be signed and will become legally binding.

The Settlement Process

After both parties have signed the property contract, a settlement date will be scheduled. On the settlement date, the buyer’s and seller’s conveyancers or solicitors will meet with representatives from any financial institutions that are involved. If everything is still favourable, then keys and the property title will be exchanged for the selling price.


At this point, the buyer’s bank representative will modify the mortgage and property title; and notify Council, the water company, the electricity company and the telephone company. The buyer’s conveyancer may need to notify other relevant parties.
