Property Transference In Cases Of Divorce?

Many people assume that a 50/50 property split is the typical course of action the Court will take in the case of divorce. However, this is not always true! Courts will consider relevant variables, including:


  • How long the marriage lasted
  • The age & health of both parties
  • Spousal maintenance requirements
  • Any inheritances received by either party
  • Each party’s assets at the beginning of the marriage
  • Each party’s financial contributions during the marriage
  • How much time each party dedicated to child-rearing (if applicable)


The Court will also consider other assets for each party including real estate, vehicles, businesses, superannuation, family trusts, furniture, jewellery, monetary gifts from outside parties, pensions and tools of trade.


The Court will further consider the liabilities of each party, including credit card balances, mortgages and other outstanding debts.
